Tips to Help Trial Testimony

Posted Thursday, June 4, 2015 by Chris Thayer

An injury lawyer Seattle can explain that the trial represents what is likely your only chance to convey to the jury your side of the story. With this realization comes a certain degree of pressure. By taking proactive steps, you can help yourself remember the important things that you need to convey during your deposition. Additionally, you can take certain steps to help you make the best impression at trial.

Review Your Previous Answers

Review answers that you have previously given in the case, including answers to deposition questions and interrogatories.

Review Your Medical History

Likewise, review your medical history so that you can anticipate questions that the defense attorney may ask you on the subject. Review which medical providers you have seen and which facilities you have visited.

Tell the Truth

Do not exaggerate your injuries or the circumstances involved in the accident. Seattle injury lawyers can explain that exaggerations or lies will almost always come back to haunt you and damage your case.

Be Polite

Talk respectfully to each individual that you encounter. Be polite to the judge’s staff. Do not attempt to be sarcastic or funny. Address opposing counsel as “sir” or “ma’am” occasionally.

Do Not Discuss Insurance

There are special rules of evidence that discuss information that can be stated at court. These rules include information about insurance. Talking about insurance without your lawyer’s advice can potentially lead to a mistrial.

Dress Appropriately

Avoid wearing flashy clothing, a lot of jewelry or a lot of makeup. Cover any tattoos and remove any piercings. Think about what you would wear to a church function and mimic this style for what you wear to court.

Defense Medical Examinations

Posted Monday, June 1, 2015 by Chris Thayer

A personal injury lawyer Seattle WA may warn you that you may have to undergo a medical examination to be performed by a doctor hired by the defendant. You may receive some of the following advice on this process:

Answer Questions Honestly

While it is important that you understand that the doctor examining you is ultimately working for the defendant, it is important that you answer all questions honestly. If the information is on a form, be sure that you provide accurate information on your medical history. Do not attempt to fake symptoms.

Ask for Clarification

Your personal injury lawyer Seattle WA may advise you to ask for clarification if you are confronted with a confusing question. If you do not understand the question being asked of you, say so. Do not answer questions hastily.

Do Not Volunteer Information

Although you must be honest, do not provide more information than is necessary to achieve this goal. Any information can be used against you in your case.

Be Prepared

The doctor may ask you about other hospitalizations or prior conditions. If these conditions are not related to your current injury, say so.

Say What You Can or Can’t Do

Pain is one of the most complex issues in litigation because it is subjective and hard to accurately describe. It may be easier for you to discuss the activities that you can and can’t do as a result of the accident. In this context, you can also discuss the location of the pain and its frequency. Let the doctor know about activities that you can no longer enjoy due to the pain. Provide enough details that show your true feelings.

Discovery

Posted Thursday, May 28, 2015 by Chris Thayer

A Seattle bicycle accident lawyer may explain the discovery process to you. This information exchange may result in the following:

Requests for Disclosure

These written requests ask for basic information about the lawsuit. Interrogatories These questions ask for more in-depth information about the lawsuit. They also ask about information that can help the lawyer handling the case anticipate the evidence that will be presented if the case goes to trial.

Depositions

Some witnesses or the parties to the case may be deposed to get an idea about the testimony they would provide in court.

The First Eight Weeks of Your Personal Injury Case

Posted Sunday, May 24, 2015 by Chris Thayer

The first two months is a key time for your personal injury case. This is the period during which you will first meet and establish a working relationship with your Seattle personal injury attorney, and much of the research will take place. The following timeline provides a rough outline of what to expect during this time.

Week One

During the first week of your case you will meet your Seattle injury lawyer for the first time and discuss the case. The Contingent Fee Agreement will be discussed with you, and you will be asked to sign authorization forms so that your attorney can obtain such documents as your medical and employment records. You will be given an instruction booklet, and the attorney’s secretary will prepare your file.

Week Two through Four

Your attorney will then begin the initial investigation of your case. This will include the following:

  • Visit the scene where the accident took place and take photographs.
  • In some cases hire an investigator.
  • Obtain the police report.
  • Interview witnesses. This may be done in person or by phone.
  • Check whether you have medical or health insurance that can help with medical costs. Make written contact with the defendant’s insurance company.
  • Send a Notice of Claim by certified or registered mail.
  • Ask you to provide any medical bills you have so far.
  • Obtain the emergency report from the hospital, if applicable.

Weeks Four through Eight

During the next four weeks your attorney will continue to investigate your case. Among other things, he will:

  • Obtain any additional medical bills and reports.
  • If a report from the Secretary of State or other entity exists, obtain these.
  • Finish contacting all potential witnesses in your case.
  • Forward medical reports and bills, police reports, and other documents to the defendant’s insurance adjuster.
  • Discuss the disposition of your case with the adjuster.
  • Determine whether any expert witnesses will be needed and, if so, retain them.
  • Meet with you to discuss your case.
